In Pennsylvania, it is indeed possible to receive a ticket for driving without a license without being cited for the initial reason for the traffic stop. Law enforcement officers have discretion in issuing citations, and it's not uncommon for them to issue a ticket for a more serious violation... View More

If the incident occurred on 7/24/23 and the citation was not filed until 11/29/23, you *may* have a statutory defense. 42 Pa.C.S. 5553(a) requires summary offenses under the vehicle code (Title 75) to be filed within thirty days of the offense. However, there are two exceptions which may be... View More

If you are pulled over in Pennsylvania and the officer discovers your license is suspended, even if it's from North Carolina, they have the authority to take it. Driving with a suspended license is a violation of law, regardless of the state where the license was issued. The fact that you were... View More

Many other factors will determine outcome. You are on probation for what? You have a license but did not have it with you? Your license is suspended? All have differing results. Best to discuss with your PO before he gets a report from DMV. I recommend you contact several attorneys in your area... View More

When you are issued a traffic citation the PD can arrest you and take you before a magistrate for arraignment; or you can sign a "promise to appear" and pledge to willingly go to court. Failing to appear on that promise is often a more serious offense than the traffic ticket, and will... View More

You need to get a lawyer to assist. The notice of suspension was because you did not enter a plea on the ticket. It was likely sent to the address on your license. If you have not already, you should contact the court and plead not guilty and then your license would not be suspended. A lawyer can... View More

Q: Speeding violation bill from rental company for speeding in Philly while on vacation, yet was never pulled over. Legal?

I was never pulled over for speeding, therefore never served anything for any alleged speeding(which I never did, since didn't feel comfortable driving back there to begin with, much less speed). What recourse do I have to fight this charge of$130 for sometime that I didn't do?

You need to determine if the speeding ticket is in your name or the company's name. Police can mail a ticket but they usually do pull the driver over first. If it is not in your name and it was not you who was the driver then this would be a civil law case and not a traffic law, so you should... View More

Plead not guilty and either get a lawyer to go to court or go to court yourself. The police office may withdraw the citation if you come to court with proof. Good luck
