Parenting time is a right, and Child support is a separate obligation. If you have an order from the court granting your request for parenting time, you have the right to. If you have not addressed this issue in the court, now would be a great time to contact a family law attorney to assist you in... View More

Compliance is paying regularly. It is often argued in the court that without a license, one is unable to work in order to pay their support obligation.

It sounds like you would do well to secure an attorney to assist you in pursuing the issues you mention. Meet with an attorney to explore court options to establish custody and support, or if you have an M case open already, seek counsel to enforce the support order.

If you are receiving benefits (health insurance or other state assistance) cooperate with the State Child Support Enforcement attorney. If you can afford to hire a private attorney to help you, it would be a good investment in your child's future.

Q: My daughter's father is on SSDI in Rhode Island, can I go after him for Child support?

DHS told me that they cannot go after him because he's on SSDI, but I wanted to know if I can go down to the Rhode Island Child Support office and file my own paper work to go after him for Child support. I don't understand how a father can not be found responsible for the children he's creating.

It is sad when parents refuse to pay to assist in the support of their children. The state is paying for health insurance and other benefits for the minor children. Hire an attorney to assist you in seeking the relief you believe you are entitled to.

If a subpoena is served, and he does not appear, the judge has the discretion to issue a body attachment. Best not to risk an arrest and some time in jail just for not appearing.

The Courts in Arizona view child support as completely separate from child custody. Unless someone else has adopted your children, a parent has a duty of support.

From your description of the situation, It's not likely he will have an resources from whence to pay his support obligation in the near future. If you know otherwise, hire an attorney to help you present that evidence to the court in rebuttal of his pleadings.
