Q: I have an eviction on my record that is not me. I am trying to find out what it means when it says order of dismissal

Lack of evidence and case file destroyed per rules of judicial admin. But this still shows on my background check.

A: An Order of Dismissal means that the eviction was dismissed. It could mean that the eviction was dismissed by the judge because the landlord did not do what he was supposed to do or the landlord could have dismissed the eviction after reaching an agreement with the tenant. A copy of the Order of Dismissal should be recorded inthe Official Records. That should allow you to detemrine the date of the lawsuit and the landlord that filed for eviction. You can then work from there to prove you are nto the person int he lawsuit. if the action was landlord A in January 2009 and you can show that you lived in a place rented by landlord B, you may be able to show that it is not your case.
