Q: If my ex husband files bankruptcy and the house is in his name will they take the house from me?

My name is on the title but not the mortgage. Since the house is not his primary residence and he does not plan on reaffirming the dept will they take the house and who will technically own the house? Will they come to me to make the payments even though I am not on the mortgage but I have made the payments for the last two years since he left. I don't want the house but I am trying to sell it but I am scared it will not sell in time. Also will this affect my credit score because I am on the title?

A: As long as payments are current, they will usually not foreclosure. I would suggest you speak with your family law attorney so you can be advise of your former spouses duties, it any.
