Q: How long into a tort product liability case would it usually be for a settlement to be offered.

A: There is absolutely no set answer. Typically, if you are one of the first people to file suit against a company for a defective product, the company may resist the claim and your lawyer will have to file suit and it can be quite a lengthy process. If a company has lost a few similar claims it may decided to settle your claim quickly.

I expect to file suit if I take on a product liability case. However, occasionally it happens that a company will settle such a suit quickly. The last time this happened to me, I had a claim for a defective stepladder and threatened to sue the manufacturer and its major distributor from whom my client's grandmother had purchased the product. I believe the product maker did not want its major distributor sued, so it settled before I filed suit. But this was an unusually fast resolution.
