Q: I received a summons to show cause for rkls driving ticket and driving w/o lic from May 2010 - why am i getting it now?

I got stopped in May 2010 for DUI, it was brought down to reckless driving, I did the classes and my License was Restricted until Feb 2011. I got stopped while driving with a suspended license and failare to obey traffic signal in Oct 2010. I received a sumons yesterday saying I had to go to court to show cause or I might go to jail. Is this right; its been over a year. My restriction was up in Feb 2011.

A: If your reckless driving sentence involved a suspended period of time in jail, you could be facing some or all of that time. But it appears you have a defense since 12 months (unless you were put on 2 years probation) have gone by since you were sentenced on the reckless driving. However, in VA, you do not automatically get your license back simply because the time has gone by; you MUST go the DMV and pay the reinstatement fee along with showing that you have valid insurance.
