Q: I was served with a Notice To Appear for Pretrial Conference/mediation about two days ago for a credit card debt
At mediation can I ask for a case dismissal? I was unemployed at the time and couldn't afford to make payments, I am employed now, but my situation has changed, I have a baby and my monthly income is limited. what answers can I give to have the case dismissed? I even have student loans currently in income based repayment for $0 because I cant afford them, so if the federal government can let me pay $0, cant i get this case dismissed?
A: You will not get the case dismissed. You will probably enter into a stipulation that you will pay a monthly amount. Be very careful, if you miss a payment a judgment can be entered against you.
