Austin, MN asked in Constitutional Law for Minnesota

Q: I have a question about the continued involvement after sentencing,of the person who did the assessment [psi].

The man who did the assessment has continued to be involved and has been directing the treatment and halfway house facilities which my girlfreind has been ordered to attend. first of all while in treatment this man was counciling the treatment facility in just how he wanted her treatment to be. he convinced them thatshe should not get her certificate of completion until she complete a four month stay at a halfway house just one day before completion of treatment. on top of that he is also interveining with the staff at halfway house to make things harder there for her. she has completed everything asked of her by the court but he continually keeps adding new requirements. 1 month after she arrived at halfway house they suddenly switched the reason she was there for. she was sent to treatment for a refusal to test at the time of arrest for dwi. she could not give a urine sample because of shy bladder syndrome. she told them she would submit to blood testingin the hospital they refused.

A: You did not ask a question, and this is not a constitutional law matter in my opinion. It is a rehabilitation matter probably concerning criminal law. In my opinion, she is fortunate to have a counselor who actually cares. You have no standing to complain. She does, and if she thinks that she has been treated poorly, she should see a local attorney.
