Q: Is there anything we can do if we paid for a property and were never given a deed?

We were approached by the real estate lady who sold us the land we built our house on in 2004. We purchased it from her. She asked if we would like to purchase an additional lot adjacent to our current lot. We said yes. She wrote out an agreement by hand that we all signed in 2009. We paid her the full amount long ago. She had trouble doing the split because of her bank requiring her to pay down her loan some more. Then she became gravely ill, cancer, now she is in remission. We see her selling real estate, buying new truck, horses, etc... But all we ever get is a stall. She says she has paper work drawn up, so that if anything ever happens to her we will get our property, but we have never seen it. Also, it has been 5 years since we paid her the money! It seems to us that we have been very patient. What can we do?

A: Send her a letter telling her that if she does not provide you with the Deed in 10 days, you will refer the matter to an attorney. Be sure to hire an attorney if you do not receive the deed.
