Melville, NY asked in Employment Law for Virginia

Q: Have to resign from my job?

I was working though a temp agency when I tripped at an assignment and fell and broke my hip and shoulder. I was approached by the attorney for the WC insurance and they wanted to buy out my life time medical because they said it would be less expensive. I have since been hired on by the temp company and work full time. The attorney said that I would have to resign from my job and never work for this company again before I can get my settlement. Can I refuse the settlement for the buy out on my life time medical and keep my job??

A: It is common for the WC insurance company to ask for a resignation when it "settles" a WC claim. However, if the claim is clear and undisputed then you may just want to get paid your lost wages and get your medical bills paid and "not" settle your case.
