A: It would depend on what type of sentence that you would want imposed upon you. If this is a first time offense then it is required that the judge give you community supervision (probation) on a conviction for a PCS>1 g. offense. You may still request a jail sentence either under the State Jail felony range 180 days to 2 years in a State Jail facility or possibly a county jail sentence under Penal code section 12.44(a). However, if you receive a 12.44(a) sentence you will serve your time in a county facility BUT you will be convicted for a felony offense.
