Q: On a month-to-month lease, on November 1st the tenant informed me that she would be leaving the apartment on December 12

On a month-to-month lease, on November 1st the tenant informed me that she would be leaving the apartment on December 12th. On December first she sent me a check that corresponds to 12 days of rent. I withheld from the deposit the balance of the rent because I believe the notification to terminate the lease applies to the end of the month and not to the departure day. I am being sued for withholding the balance. Please advise if I should return the balance. Thank you for your time
