Buffalo, NY asked in Probate for Florida

Q: My father inlaw passed away and had a home in florida. He left the home to his 4 children and 2nd wife who is not

the mother of any of the children. His intention was as long as she payed all the bills she could live there. We are aware of Life Estate. The home will need a roof soon and the kid are in no position

to pay. The propery currently is only in my father inlaws name . If they do not probate are they still responsible to pay for any capital improvments. His second wife is 83 years old. His will states the home should be divided in equal shares. The wife and kids did not get along. My father inlaw and second wife were only married for 2 years. The kids want to wait until she moves out or dies to probate to avoid any financial responsibility. Help!
