Q: My boyfriend was convicted of domestic violence with a prior. What constitutes the prior?
This is his 3rd arrest for domestic violence. The first in 1991, the 2nd in 2004 and the 3rd happened in 2014.
A: Either one of his prior arrests may have resulted in a conviction for a domestic violence offense, this would be a prior offense for purposes of enhancing the current DV conviction.
