Macungie, PA asked in Workers' Compensation for Pennsylvania

Q: I work in Amazon and have a WC claim opened since January 2014 because of my hand. Can I open another claim for my back?

My back is hurting too much since about 2 months after I started having problems with my hand and the EMCARE woman and the WC Manager told me that I should go to my PCP to be check up, but what about if it end up to be related to my hand issues and it is a WC injury? When I asked EMCARE to open another claim she said no because is not work related, how can anybody knows that just by looking at you? I'm scare to lost my job if I insist that they open a new claim. Could you please give me an advice of what to do?

A: First, having an "open claim" with Amazon and having a claim that has actually been accepted by workers' compensation are not necessarily the same thing. Second, if you want to fill out an accident report, you should be allowed to do so. Third, if you do have an open workers' compensation claim, you should have been provided with a list of 6 providers you could treat with other than EMCARE. Furthermore, you only have to treat off the list for the first 90 days and then you can treat with whoever you want. Since this is Amazon, I have a fairly good idea in regard to whether or not any of the above happened, so my final suggestion is that you contact a lawyer and review your rights. The initial appointment is free so you have nothing to lose by doing so.
