Youngstown, OH asked in Criminal Law for Ohio

Q: Can a dv case be dropped if it was filed by the police for a minor scratch?

The police showed up at our house after my mom who was not even there called. I had returned home from a restaurant and my gf thought i was talking to another female. She proceded to slap at me and i grabbed her hands to protect myself. She had a finger print bruise and a scratch on her hand. She did not file charges and told the officer that she did not wish to file a charge, Needless to say the officers arrested me. She is going to court to talk to the prosecutor and ask that the case be dropped as she does not wish to file anything. What are the chances the prosocutor will recomend a dismissal.

A: There are no guarantees. However, if this is your first arrest and the injuries are minor, there is certainly a chance to get the case dismissed.
