San Diego, CA asked in Real Estate Law for California

Q: part of closing was a possession amendment allowing seller to stay until end of month. Seller refuses to leave

Seller refused to leave by date on C.A.R. It's past date on agreement. Seller feels it's her right to stay another week for free. What can I do? I am afraid that Seller will keep prolonging

A: If the buyer and the seller initialed the CAR arbitration clause, then you can arbitrate the case. The CAR agreement allows for attorneys fees to the winner. That week isn't going to be free.
