Q: On a first offense how long can i go to jail for back child support?
$ year old warrant just reactivated due to loss of job and not being able to pay for 4 months. Have a new job but cant get to it if they lock me up for 6 months. Never missed a payment until recently. How long am I looking at
A: Non-support is generally a first degree misdemeanor carrying up to 180 days on a first offense. It can, however, be a felony of the fifth degree, carrying up to 12 months, if during the past 104 weeks (two years) you have failed to provide support for an accumulated 26 weeks whether or not those weeks were consecutive.
