Q: My husband kids from a previous marriage are in my care and live in the home with me can he give me temporary custody?
My husband is not currently living in the home but his children from a previous marriage live with me. Him and the kids mother has shared custody however he is technically homeless nut for the summer and holidays and weekend when he gets the kids they are in my care and in the home with me. Can he temporary give me his rights over the kids to me? will he have to file a motion or can we just submit a notarized appointment of guardian and/or temporary total custody form to the courts?
A: No, he cannot do that. Their mother needs to know about all of this.
