Q: If my mom dies and her only bank $ was less than her credit debts do i have to pay them? is pension distribution liable?
her credit debts are about 5k, pension distribution to my sister and i totalled 13k after taxes, her only bank account has about 1,300.00. Do we legally have to use the distribution/checking acct funds to pay the credit cards?
A: What you need to do is go speak with a probate attorney about this. You have to open an estate and the credit cards have to be paid.
