Bentonville, AR asked in Real Estate Law for New Jersey

Q: In NJ do you need spouse signature to sell a property which was bought with cash on an individual name?

This house in Mullica Hill, New Jersey was bought from a bank for the family to live in and to expedite negotiation with the bank it was recommended that an individual should be used. Settlement was also done on the same individual (husband) name. After settlement wife is ticked off by not having her name on the title of the house and has refused to move in to the house.

Husband has no objections adding her name to the title of the house but for the the worst case scenario; Does he

need spouse's signature to sell the house or he can sell it independently?

A: It sounds like this is clearly your sole and separate property, so no her signature is NOT needed. Good luck.
