Boston, MA asked in Immigration Law for Massachusetts

Q: Seeking advice from field experienced immigration lawyer on marriage fraud. Thank you.

I had faked my marriage to come to US in 2004 and over stayed my visa with my real husband. I have 9 years old us born daughter and 24 years naturalized US citizen son. My (real) husband is in the process of getting legal documentation through political asylum, and the case has been continuing for 10+ years. Are there any hopes for me right now? Are there any legal solutions that can be apply toward my legal documentation. Thank you.

(Definition of my fake marriage: I went with a men (fake husband) to the US embassy and provided false documents to prove that he was my husband. we came to US on visit visa. He had left and i stayed with my real husband (real husband: who came to US long before me )

A: Your situation is very very tricky however you may have some options. If you can prove that you divorced your fake husband and married your real husband you maybe able to apply for a green card through your 24 year old son. Talk to an immigration attorney in private. All the best.
