Q: My sales contract was signed by attorney in fact. I learned after deal fell apart he was not and I lost $.

I entered into a real estate contract with the son of the deceased owners (mom is actually still alive) on August 1/2, 2015. One son was named the trustee in an irrevocable trust dated March 2015 while both parents were still alive. The son mislead me on parents status and then did not disclose a major water claim in 2012 for 17K preventing me from having my home inspectors look at it. The house appraisal (V.A.) came back 32K below listing and 22K below offer. Son (seller) walked and I lost inspection fee and appraisal fee. Son also refused to reimburse me for the termite inspection I paid up front for him. I then learned he did not accept trustee of the irrevocable trust until 5 days after he entered into contract which gave him his authority to sell his mothers property (I assume) but being told he still did not have the right to sell if she was still alive. Do I have a case to get my money back?

A: Whether you have a case to get your money back, you would have to hire an attorney to find out and would have to pay the attorney probably more than it is worth. It will not hurt to go see a local real estate litigator for the specific advice that you need.
