Providence, RI asked in Family Law for Rhode Island

Q: Can I disagree to extra curricular activities?

My daughter's mother and I are going to court to establish custody, visitation and child support to have it on a court order. She has my daughter in several sports. I do not agree with her being in so many sports, nor during my time. I know that there is no custody established at this point but if we get 50/50 or not, can I say that I don't want my child in sports during my visitation time? Am I able to spend my time with her the way I please, as long as she is safe and not in danger?

A: The focus should be the child's best interests. For example: If your child is an Olympic equestrian and you do not wish to support her endeavors, the judge may choose to curtail your visitation during those riding events.

50/50 parenting is an illusion . Your child deserves 100% of her parents love, affection, support and resources. This is impossible to measure in minutes and days. Co-parenting is most difficult when parents are separated. Your child deserves your cooperation and best efforts to present a unified parenting plan that will likely include compromises from both parents for their child's benefit. If you are unable to decide, the judge, with the professional assistance of legal counsel, will decide for you. This will not likely be exactly what either of you had in mind but shall become an order of the court.
