Q: Can a landlord evict a resident for unpaid mortgage payments;When the billing statements was only showing lot rent due?

I was in the process of buying the property but I couldn't afford the yearly insurance that the bank was requesting.So, in the process the landlord didn't bill me for the mortgage payments for the last 6 months, instead they billed me for only the lot rent. I have documentation for this action. Now,I am being billed for back mortgage payments all at once and they want to evict me for nonpayment and gives me no time to pay for it. I have 3 days to come up with the money or relinquish the property.

A: The answer varies based on whether the rental is commercial or residential. You have greater protections if the eviction is for residential use. Both raise significant issues of inadequate notice (which usually slows, but does not defeat a eviction). Generally speaking you cannot be evicted from rental property (even if you are wholly in the wrong) without a court order. It does not sound like any order is in place. Contact an attorney; you can probably stop the eviction entirely or at least give you breathing room to find the money.
