Asked in Family Law for Rhode Island

Q: I need advice! My daughters father is not on the birth certificate and has been pretty much absent from her life.

Shes 2 now, hes never really been in her life, just when she was under a year old for a few months, he shows up here and there on rare occasions, hes mentally unfit and doesnt have a great background, domestic violence tiwards me, molested his 2 siblings when he was about 10, was "sleep walking" when his dad found him in the basement with gasoline and children in the home, made threats towards me and my daughter, and verbally abused her to me to "hurt me" amd i have a message of him saying she doesnt mean absolutely anything to him. Will he get joint custody or anything for that matter, and can he stop me from leaving the state?

A: Meet with a family law attorney to review the particulars in private. If he is not on the birth certificate, he shall first have to file with the court to establish custody and visitation. This will benefit you in that if he is adjudicated to be the natural father, he will have an obligation to provide child support. It is difficult to predict what the outcome of the case will be at this point.
