Q: Can a mobile home be put in a subdivision that has filed covenants, but no HOA in place?

I live in a subdivision in Argo Alabama and the builder went bankrupt before an HOA was set in place. Our neighborhood was also never zoned/annexed into the city limits. We do have covenants that our filed with the city. We had a few lots that did not percolate in the neighborhood and someone just recently bought them from the bank and they are clearing them off now. We have strong indication that they are about to put mobile homes in our subdivision. Do we have any legal grounds to keep this from happening? We do not have an HOA, and not enough of the neighborhood is on board to start one.

A: Assuming that mobile homes are prohibited by the covenants, yes, you may have a case. Ask an attorney in your jurisdiction about suing to enjoin any mobile homes.
