Yorba Linda, CA asked in Landlord - Tenant for California

Q: Back in June, my mother gave a 2 month notice to vacate an apartment. Do I need to issue a new 2 month notice?

Mother is out of the country, but I manage her property. She did not give the renter his receipts for rent paid before leaving. He was denied an apartment because of lack of receipts. He did not move. When I returned at the end of August I told him he could take two more months and gave him his receipts. What should I do? Do I continue to accept rent?

A: If you accept rent after the 60 day period, then you are waiving the 60 day notice to vacate. You'll have to serve new notice to terminate the tenancy.
