Q: We are seeking information on a immigrant getting custody in arkansas. Is the law whats in the best interest of child.

My husband is a non u.s citizen who lives in arkansas. We have had custody of the oldest son for almost 4 years now. About 7 months ago his ex wife got all her other children taken away including his youngest son because she had a new born baby who tested positive for drugs and herself and baby father all Tested positive for drugs. We are trying to get custody of the youngest son because we found out is was being abused physically and educationally. We had him tested and also have tons of documents stating in our favor. I have been researching all over and it clearly states immigration status has nothing to do with getting custody of a child. It states its whats in the childs best interest where they stay. My husband is waiting on a appointment to finalize his last step to getting his visa to stay here in the u.s. I am in need of information. The judge just wants the green light before giving him custody. She also has a reaccurance of past history of the same things.
