Newark, NJ asked in Real Estate Law for New Jersey

Q: Trying to make an offer on a property. Our RE agent is refusing to make our requested changes to # of atty review days.

Since we have not decided on an attorney yet, we know it will take longer for the attorney review to begin, so we want to increase the attorney review days. I understand we can request a change to the number of days once the offer has been accepted, but since we already know we need more attorney review days, why can't we just change them now. I'm thinking of going to the seller agent directly and requesting a written contract so we can make the change ourselves (our agent wants to dot loop the contract and refuses to make the changes we requested). Can we do that?

Is the agent inadvertently acting against our interests, especially since there are two other offers already on the table and time is of the essence?

A: No, the attorney review does not start until the attorney reviews the contract, but you will have a "reasonable time" to obtain an attorney. Good luck.
