Q: parents died without will,quickest way to transfer deed to rightful heir(s), without going through probate

3 of 8 kids were living in house; due to financial hardship, couldnt pay water.. it was shutoff for about 8days, when code enfocement came , posted " restricted entry" notices and told them they had to be out by dark (APPROX. 3 HRS). Borrowed money, paid water in full; but now, in order to have water turned back on; deed needs to transfer into one or all of the kids name, because water bill was still in fathers name. trying to get back into house, because they are now homeless!!!

A: Whether or not a probate action is required depends on the value of all of the assets of the person who passed away. If all of the value of the property is less than $150,000, then it is much quicker to transfer the assets. If it is more, than it will take about six to twelve months. Or, if the house is worth less than $50,000, there is another procedure to transfer it quickly.
