Q: Deflamation of Character
I have a son who has gotten into some domestic issues with girlfriend at college. He was given a citation to appear Friday then on Tuesday the young lady went on Facebook and posted his picture and also accused him of sexually assaulting another young lady. Do we have legal grounds as far as the deflamation on facebook? The dean of the school did make her take the post down however it was already seen by several by this time.
A: This is in the wrong forum. It is defamation not deflamation. And one big problem is that the person who did this is probably judgment proof. In other words she does not have much money. So, you would probably have to pay an attorney a lot to file a suit. What you have asked about is civil, not criminal.
