Denver, CO asked in Landlord - Tenant for Colorado

Q: My landlord is refusing to respond to me about my security deposit, what do I need to do now?

My boyfriend and I moved out of a property over a month ago. I have attempted to get in contact with my landlord multiple times about returning our security deposit, with no response. I have also sent a demand letter to an address that I found but I found out yesterday that it is "undelivered as addressed". I am unsure of what I need to do now to get my security deposit back from him. I have googled him because he told us that he worked for a Remax agency and found out he no longer works there, multiple different addresses for him and the company that he used to pull rent from us says inactive - revoked (tax). What are my next steps, can I sue him for not returning my deposit?

A: Yes, you can and should sue your landlord. If your deposit is under $7,500 you can use small claims court (better for non-lawyers). Finding your landlord may be a problem (as it appears he is in financial distress), but you or a private investigator can find him. Here is a link to the Co courts which outlines filing for small claims court (click on "judicial branch") http://www.intotolegal.com/upcoming%20Events/Forms.html . Here is a also a link for free/low cost legal services (hiring a private attorney may be cost prohibitive) http://www.intotolegal.com/upcoming%20Events/Pro%20Bono%20Services.html . I'm sorry this happened to you and I wish you luck with your case.
