Q: In LA county how long does a probate sale of a condo typically take from time of accepted offer to close of sale?

My 45-day escrow closed last week, and I'm waiting for the court approval. The estate attorney won't answer any calls or emails from the listing agent. I just want to know how long this is going to drag out. Thanks.

A: In probate, we say that it's going to take as long as it will take. There are arcane procedures in probate that are time consuming. Assuming that you letters issued, court has ordered the property sold, and the attorney has sent the application for court approval, notified everyone who is required to be notified, published in the newspaper, then you are just waiting on a court date which should be set within 60 to 90 days. At the hearing, other buyers can bid on the property. Then the closing can happen.

A: It really depends on whether you have Independent Authority to sell the condo without court confirmation. Once it is sold, then you should be filing a Final Account (unless waived) and a Petition for Final Distribution. If the attorney is not answering, then consider finding new counsel, or show up at the attorney's office.
