Q: I am in the process of buying a condo with water damage inside due to a leaky roof. Is the Association responsible?

I can repair the drywall, no problem, but I am seriously concerned about mold and structural damage, as it's been raining heavily this past month. The Association claims they're not liable since the leak wasn't reported in a timely manner (the property was bank owned and vacant, then sold at sheriff sale). They will fix the roof, but are refusing interior repairs. Can anyone advise me if there is a case here? If I buy the unit and develop allergy and health issues related to mold?

A: Whether or not the association is responsible, requires an examination of the By Laws and more specific facts than you have provided. You need to have an in person consultation with an experienced attorney. Good luck
