Q: now company A found guilty - can I get priority date of 2007 or 2011 ( my inital I140 was denied due to Fraud employer

1) Currently on H1b + I140 approved from employer B - PD June, 2015

2) I140 denied from employer A - filed in 2007, denial letter 2011 - reason for denial Abondone due to company didnt respond to RFE about company's financials

3) Employer A - convicted for Fraud in Nov 2015 - found guilty on several charges

4) I received letter from VNS US Department of Justice informing me of my rights as Victim - one right says - I am entitled to Restitution

My question - I lost 8 years of my life waiting for Green Card -now company A found guilty - can I get priority date of 2007 or 2011 (when my inital I140 was denied due to Fraud employer)

A: You may be able to retain your priority date, I suggest talking to an immigration attorney about this issue in private so he/she can analyze your files and confirm the same. Many immigration attorneys including me offer free consultations, make use of the consultations. All the best.
