Q: Can a company (as a defendant) win a personal injury case without the driver of their vehicle that caused the accident?
This was a left turn accident on Sept 15, 2015. The passenger in the defendant's car is available but they cannot find the driver. Both driver and passenger of the other vehicle are available.
A: They could, but it would be more difficult as the plaintiff would intimate as to why the driver was not available, that being because they caused the accident. On a side note, there is still time to locate the driver, as many times a case will begin with a party later located.
A: If they don't show up your lawyer can ask for them to be non-suited but that isn't always given.
