Q: Innocent Spouse Relief denied for back taxes owed. Ex husband agreed to pay in divorce agreement. Do I have a case?

My ex-husband and I owe back taxes in excess of $10,000 (including interest and penalties). In our divorce decree dated 2012, he agreed to pay all taxes we owed jointly (filed married). He stopped paying on those in 2014. I filed for Innocent Spouse Relief and was denied. In the letter it said to settle this in Civil Court. Do I have a case? Can you help and can I win? Thank you for your time.
