Saint Cloud, MN asked in Employment Law for Minnesota

Q: Can a company have language in a CBA that is in violation of Federal Law.

The Equal Pay Law states that employees are to be paid the same wage for the same work, can language make it possible for the company to pay some less.

A: To determine whether a provision of a CBA (or any other employment contract or policy) violates state or federal law, it is necessary to review the provision.
