Q: i had blood drawn at TISH in nyc and my arm totally blue and bruised inches around the place where the blood was drawn

i went back today for another draw and the other nurses could not believe my last draw and the arm. they told me to see supervisor which i did. do i have a case. they nurses today said that was terrible and they were gossiping about the nurse who ruined my arm. my arm hurts from the bruises. i have pictures. i am 23. i live in nyc

A: The problem is you do not really have any damages. In a personal injury suit you need something like medical bills to show it was bad enough to treat.

A: Medical malpractice cases are quite complex, risky, and expensive. While there may have been poor care provided, it would be difficult from a practical standpoint if the injuries resulting from the alleged malpractice were limited to bruises and / or short term injuries. Cases are evaluated from both a legal standpoint and practical standpoint. Hopefully, you have a full recovery from the injuries / complications and can move on with your treatment. Certainly, injuries resulting from poor care are not acceptable but they may not be actionable from a practical standpoint. Good luck.
