Q: A person who was lost drove down my private lane(not posted as do not enter,etc.) my dogs jumped on their car and caused
damage. Am I responsible? This was on my private property.
A: A lot will depend on whether or not it looks like a driveway, acts like a driveway. If it looks like a nice small roadway then you should put a sign "private driveway." First, turn it over to your homeowners--I think a good argument can be made it's not on you but on them. However, you need to give your homeowners pictures of the entrance area--does it have a sign that says it's a road (for instance, "Dogjumping Lane " or "Canine Caper Drive"? If not, where did they get the idea it was a road--i.e. were they being reasonable under the circumstances).
