Doubt first degree, not even sure about others. I'm not aware of any precedent. There would likely be civil liability. There would also be problems proving that the marijuana in the driver's blood came from that cookie and not from another source.
If you are concerned about the public safety aspect suggest you notify the police and let them handle it.
