Q: Can someone demand their $ back from a sale of a horse 7 months later?

We sold a horse last Oct and she did not do a vet check. She now claims the horse has ringbone which our vet never said anything about and he is one of the best in the state. He does have a low heel that we told her about. She is demanding her money back plus all her vet bills she incurred. Talking $4500 plus $1000 vet bills

A: Review your purchase agreement to see who carries the risk of loss for the horse. The buyer can bring suit in small claims if they can prove that you knowingly withheld information (low heel can be a sign of ringbone). If the buyer cannot prove knowingly withholding on the part of the seller, the case moves into a grey area that is wholly driven by the fact and circumstances of your case.
