Colorado Springs, CO asked in Divorce and Family Law for New Jersey

Q: Verbal agreement (NJ) after written marital settlement agreement (FL). Can I sue for breach of verbal contract in NJ?

My ex and I have a marital settlement agreement (in FL) that states that I will pay support for the kids while they are in college as long as there is no more than a 4 month gap in enrollment. My daughter was accepted into an out of state college program that started in Aug (she graduated HS in May). The ex did not want her to wait until Jan to start college so she told me she would not persue the CS after HS as indicated in the marital settlement agreement. I agreed to let my daughter start in Aug and paid for her college via my GI Bill. The ex filed for arrears for the 2 years my daughter spent in college. Can I sue for breach of contract in NJ to try and get the money back? I paid $650 a month for 24 months ($15,600.00)because my ex broke our verbal agreement and lied in court (saying there was not an agreement) when she recovered the arrears.

A: You are not going to be able to have this answered in anything other than an in person consultation with a full review of all documents. An oral agreement MAY or MAY Not be enforceable. A lot more information is required. Set up an appointment with an experienced matrimonial attorney right away. Good luck.
