Q: I have researched some information that you indicated were needed and I'd like to ask a follow up question if I may?
Thank you sir for your help! I am awaiting a call back from an attorney. I retrieved information from the website. The insurance company's attorney filed form LIBC-378. Selected Position: Terminate Compensation Benefits (Stop payment of Workers' Compensation) requesting the date of 1-6-2016 to order the selected action, which is the day I attended an IME. The reason says that I made a full recovery. They requested a Supersedeas and their reason is based on the documents to be submitted at First Hearing (Im assuming this is the IME) They claim "Have been paid based on Notice of Compensation Payable" under Compensation Benefits. They left the question "Date of most recent compensation payment" unanswered although it was Jan 27. Is that enough information to determine what benefits may be outstanding? Do you have any idea what strategy they may be attempting? Do you believe what they did was illegal? Thanks in advance for your help again! I really appreciate it sir!
A: I hate to guess, but assuming that there is a Notice of Compensation Payable, and the Petition to Terminate was the next document filed, there may well be any issue with a unilateral suspension/termination of benefits from 1/27/16 forward.
