Q: My neighbor and I rent from the same person. her dog got out, bite my dog and I got injured in the process. Who's liable
My dog was on a leash, hers was not. My dog is registered/up to date on shots, hers is not. My dog was the one who bit me but I was trying to protect the other dog/children that were around
A: You need to speak with a lawyer and develop more facts. Had your neighbor's dog ever gotten out before? Did your neighbor's dog ever attack people or other dogs before? Was your neighbor careless in confining her dog so that it got out? Simply put, there is not enough information here to answer your question.
A: It appears that Pennsylvania has a series of laws in place as to dog bite cases. The law on point will depend in part as to whether the injuries are severe or not. Furthermore, dog bite cases from a practical standpoint should be evaluated as to the presence and amount of liability insurance if any. If there was a dog leash law in effect, this will help you. Your involvement in the situation will likely be closely scrutinized and questioned if you decide to pursue this matter. The case or potential case is certainly worth meeting with a local personal injury attorney for a free consultation.
