Elk River, MN asked in Landlord - Tenant for Colorado

Q: Can I get prepaid rent back? Moved out early per landlord's request.

Signed a lease for 7/20/14 - 11/20/14 and prepaid 2919.64 (rent+$500 security deposit). Moved out after 27 days per landlord's request that "it wasn't working out". I left the keys with the next door tenant and left the unit in perfect shape. She never returned unused rent. Received full $500 security deposit back 12/16/14. Can I recover any of the rent she kept? I am now located in Minnesota and the property is in Colorado.

A: You should receive at least a pro rata amount of the unused prepaid rent. From your facts you have a legitimate claim. Now the problem, to collect you will need to file suit in Colorado. You can file in small claims court pro se (w/o an attorney) or you can hire an attorney (shop around, some lawyers may be willing to work at a reduced fee or contingent basis).
