Mechanicsville, VA asked in Family Law for Virginia

Q: What expenses are presumed to be included in child support payments under Virginia law?

Are extracurricular expenses such as OPTIONAL school club related trips presumed included (eg a school club's State Convention for $260)? Another example is the high school class ring ($389!!!). I asked my ex to share the above expenses and he says they are included in child support. I have sole physical custody and pay all other expenses like school fees, lunches, food, clothing (even special clothing for the club), cell phone, medical insurance, food etc. We share reimbursed medical according to State guidelines.

A: Usually, the only expenses expressly added to child support that affect calculations are insurance costs, daycare costs, and the reimbursement provisions you stated. It is presumed that the child support calculation covers the other parent's share of basic needs for the child. Unfortunately, absent some agreement to the contrary or a showing of special need on the child's part, the other costs you indicate are generally not going to be ordered to be split. Speak with a local attorney to see if you have a basis to request more support.
