Delray Beach, FL asked in Family Law for Florida

Q: Am I able to file a pro-se motion in Florida if Dept. of Rev. is enforcing current child support order?

I have an order for child support in Florida. The Dept. of Rev is currently enforcing order. My son turns 18 in 2 months which is when the order ends. My son will not graduate high school for another year. I was told I can extend child support with a letter from the school with expected graduation date. The Dept of Rev has made so many errors AND take 6 months to do anything. Am I able to file a motion on my own to have it extended (to save time) or do I have to go through Dept. of Rev.?

A: Who told you that it could be extended for another year? This may, or may not be correct.

If the Department of Revenue has appeared in your behalf, technically you cannot file a motion unless the department first withdraws. But if the department has instead appeared in its own behalf, yes you should be able to file such a pro se motion.
