Q: Once you waive your speedy trial, how many years can you be incarcerated Before your due process right isviolated.

This person has been incarcerated in the Palm Beach County jail since 2007 to present date. The charges are first degree murder and arm robbery. The arm robbery was down filed to robbery a couple years later the information was amended and upgraded to arm robbery. Dna was tested from the crime sence when she was 16 and and was negative. At 25 or 26 years old her Dna was tested and she was charged with first degree murder.

A: Unless her speedy-trial rights were waived (generally by herself or her attorneys in her behalf), the speedy-trial rules would have long since mandated that the charges be dismissed.
